TERMS & CONDITIONS

By booking and paying for a tour with Kerry Experience Tours, you agree to and accept the following terms and conditions. This agreement is between you, the participating passenger (henceforth referred to as “you”) and Kerry Experience Tours, Derreenavurrig, Sneem, County Kerry, V93ECF1, Ireland (henceforth referred to as "Kerry Experience Tours"). By making a booking with Kerry Experience Tours, you accept on behalf of yourself and all those joining you on the private tour, including minors and persons under a disability, to be bound by these Terms and Conditions.

BOOKINGS AND PAYMENTS

To make a booking and guarantee your vehicle of choice for your private day tour (single day tour), you provide payment in full upon reservation. A 10% online booking and administration fee is included in the total price; this fee is not refundable.

Please not that any admission fees to attractions you might decide to visit during your private tour, are not included in the tour rate, and are payable on the day of the tour.

For Multi-day Private Tours a non-refundable deposit of 10% of the total price is required upon reservation. The balance is payable latest 8 weeks before the start of the multi-day tour.

Private Day Tours can be booked and paid for through a link on our website. When the booking is successfully completed, you will receive a booking confirmation email with attached a tour voucher (pdf) containing the details of your Private Tour reservation. It is your responsibility to check the accuracy of the booking and the dates of travel.

Customized Private Tours and Tailormade Multiday Tours can be paid online - we will email you a link that you can click on to pay - or can be paid via Electronic Bank Transfer.

The online booking system used by Kerry Experience Tours is powered by an authorized agent called Trekksoft. All online credit card payments will appear on the customer's credit card statement as paid to Trekksoft. Please send an email to finance@trekksoft.com for all inquiries regarding your credit card payments and chargebacks. In the event some cards are not accepted, please do get in touch with Kerry Experience Tours directly in order to book.

Kerry Experience Tours accepts Visa, Mastercard and American Express. Kerry Experience Tours is not responsible for any charges applied to credit card transactions or conversion rates and will not refund or return any fees charged by third parties and incurred during the transaction of the tour cost.

CANCELLATION POLICY

Cancellations must be made in writing to info@kerryexperiencetours.ie and will not be valid until confirmed to you in writing (email) by Kerry Experience Tours.

The cancellation policy for a Private Day Tour (single day tour) is as follows:

All Private Day Tours (single day tour cancelled at least 2 (two) days / 48h prior to the tour date are fully refundable less the 10% booking & administration fee. Any cancellations made within 2 days / 48h of the tour date, or in case of no-show, are non-refundable.

The cancellation policy for Multi-day Private Tours is as follows:

Cancellations made at least 8 weeks prior to the start date of the multi-day tour are free of charge, except the 10% deposit payment which remains non-refundable.

Cancellations made between 8 and 4 weeks before the start date of the multi-day tour are entitled to a refund of 50% of the balance payment; the deposit payment remains non-refundable.

Cancellations of multi-day tours made within 4 weeks prior to the start of the tour are non-refundable.

CHANGE OF TOUR OR DATE

We understand that travel plans may change. You must notify us in writing by email of any desired changes to your reservation including the day tour of your choice and start date, time and location. Changes of type of day tour, tour date, or start location are subject to availability and may occur in an additional charge. Changes are not valid until you have received an email from Kerry experience Tours confirming the changes of your reservation.

DRIVER-GUIDE

Our private day tours and tailormade multiday tours are conducted by a professional driver-guide (one person) who is both the driver & guide.

TIPS

Gratuities for personal services and to driver-guides are not included in the tour cost.

NOT INCLUDED

All items of a personal nature (including food and drinks) and all admission fees where applicable are not included and must be paid for by the participant.

FORCE MAJEURE

If Kerry Experience Tours needs to suspend your tour because of force majeure we will not be liable to pay any refund. In these circumstances we will offer you an alternative date or tour, or a credit voucher towards future travel with Kerry Experience Tours. The credit voucher can be used for future bookings of the equal value or more within one year from your original tour reservation.

Force Majeure can include, but is not limited to, war, the threat of war, civil strife, pandemic, terrorist activities or the threat of terrorist activities, acts of governments or local authorities, strikes, industrial disputes, demonstrations, natural disasters, unnatural disasters such as explosions or any similar event which is outside our control.

Kerry Experience Tours may not be held responsible for delays due to mechanical failure, or other issues that may arise and are outside of our control.

TRAVEL INSURANCE

The price of Kerry Experience Tours does not include travel insurance. Kerry Experience Tours strongly recommends that all clients take out comprehensive insurance cover for cancellation, medical expenses, personal accident, personal baggage, money and public liability before travelling. Kerry Experience Tours accepts no responsibility for the theft, loss or damage to personal belongings or liability for personal injury/death at any time during the duration of your activity/tour.

PHOTOGRAPHS AND VIDEOS

During your tour, your driver/guide may take photos or record videos of you participating in the Tour or you may provide us with photos or videos that you have taken. You consent to us publishing such photos and videos and details (including but not limited to your name, location and date) for our marketing purposes including on the Site and social media.

SPECIAL OFFERS & DISCOUNTS

Occasionally Kerry Experience Tours will offer a promotion or discount for one or more private day tours. These promotions are only valid during the outlined time period shown in the promotion. If no time period is listed Kerry Experience Tours reserves the right to discontinue the promotion at any time. Offers are only valid on new purchases made online at www.kerryexperiencetours.ie. Discounts cannot be applied to pre-existing bookings.

YOUR DATA AND SECURITY

We collect personal information about you in order to allow you to make a booking for a tour on our Site, to process your booking for a tour and to contact and communicate with you or to respond to your enquiries.

When collecting and using your personal information, we agree to comply with the Privacy Principles as set out in Irelands Data Protection Act 2018 and any other applicable Laws.
We may disclose that information to third-party service providers who help us deliver our services and Tours (including information technology service providers, data storage, web-hosting and server providers, professional advisors, payment systems operators and our business partners (including third party tour operators)) or as required by law. If you do not provide this information we may not be able to supply our tour to you. By providing personal information to us, you consent to us collecting, holding, using and disclosing your personal information in accordance with these terms.

CLAIMS OR DISPUTES

Should a participant have a complaint in respect of their tour, they should inform the Kerry Experience Tour Driver-Guide (one person) during the course of the tour. If the matter cannot be resolved after Kerry Experience Tours’ best efforts to do so during the tour, the participant’s complaint should be submitted to Kerry Experience Tours in writing no later than 28 days after the end of the tour. Please note that if you attempt to address a situation on your own without using the Kerry Experience Tours procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

LAW

The participation contract with Kerry Experience Tours is subject exclusively to Irish Law and the jurisdiction of the Irish courts.

RESPONSIBILITY

The participant is responsible for all travel arrangements and costs to/from the point of commencement/conclusion of the tour. It is the full responsibility of the participant to check the accuracy of the dates booked upon receipt of their travel documents. It is the responsibility of the participant to ensure they have a valid passport and all visas if required. Kerry Experience Tours is not responsible for any personal injury, property damage or other loss a passenger incurs on any tour arising from acts or omissions by any air carrier, public transport company, hotel, car rental company, subcontractor or other person or organisation, whether or not such company is rendering any services supplied on the tour. Without limitation, Kerry Experience Tours is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation any willful or negligent act, failure to act, breach of contract or violation of local law or regulation of any third party such as an airline, train, hotel, bus, taxi, van, local ground handler or guide, financial default or insolvency of any supplier and/or restaurant which is, to, or does supply any goods or services for this trip. Kerry Experience Tours is not liable for any loss, injury, death or inconvenience due to delay or changes in schedule, overbooking of accommodation, default of any third party, attacks by animals, sickness, the lack of appropriate medical care, evacuation to same, if necessary, weather, strikes, acts of God or government, acts of terrorism, or the threat thereof, force majeure, war, quarantine, epidemics, or the threat thereof, criminal activity, or any other cause beyond its control. Kerry Experience Tours reserves the right at its sole discretion to alter the itinerary as it may deem necessary or advisable. Any disclaimer of liability by Kerry Experience Tours under this clause is enforceable to the maximum extent permitted by applicable law. Each of the provisions of this clause is severable and if any such provision is held by any court or other competent authority to be illegal, void or unenforceable in whole or in part, the legality, validity and enforceability of the remaining provisions of this clause shall not be affected or impaired.

IMPORTANT

Kerry Experience Tours accepts no responsibility for losses or expenses due to delay or changes in schedules, flight cancellations or misconnections due to mechanical problems, sickness, quarantine, weather, acts of God, strikes, government actions, war, terrorism or other circumstances beyond its control. Participants must bear all such losses or expenses. To guard against unforeseen circumstances, we insist you travel with comprehensive travel insurance which must be purchased at home before travelling on tour with Kerry Experience Tours.

Should you miss the arranged start time of your tour, for any reason, there are no refunds or exchanges available for any sections of the tour that you may have missed out on due to having not made the arranged pick-up.

LIMITATION OF LIABILITY

Third Parties: We may provide tours & activities to you using third parties. We make no representation or warranty about the services provided by third parties, and to the maximum extent permitted by law, we exclude all responsibility and liability for the third-party services, or their failure to provide the services.

Warranties: You acknowledge and agree that the information and material on our Site may be inaccurate, incomplete or unavailable from time to time. To the maximum extent permitted by law, all information and material are provided to you without warranties, guarantees, representations or conditions of any kind, either express or implied, and we expressly disclaim all warranties, guarantees, representations or conditions of any kind.

Exclusions: To the maximum extent permitted by law, we exclude all liability, and will have no liability, for:

-the Site or your use of the Site;
-any acts or omissions of you (including your participation in any Tour);
-any acts or omissions of any third party (including, but not limited to any government agency, hotel, tour operator or airline);
-any event or circumstance beyond our reasonable control;
-any information or documentation supplied by you;
-any property loss or damage (including to your baggage) or personal injury, loss or death; and
-any Consequential Loss.

Limitation: To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will be limited to us either, at our sole and unfettered discretion, resupplying the relevant Tour to you or paying to you an amount not exceeding the fees paid by you to us for the Tour the subject of the claim.

Indemnity: You indemnify us from and against all Claims (including legal costs and expenses on a full indemnity basis) resulting from your breach of these Terms.

The obligations under this clause (‘LIMITATION OF LIABILITY’) will survive termination of these Terms and Conditions.
